AKUMA Kaizen, LLC, a Nevada limited liability company doing business as MASSFx Combat Athletics ("MASSFx," "we," "us"), respects your privacy. This Privacy Policy explains how we collect, use, share, and protect personal information through massfxcombat.com (the "Site"), our member platform, and at our facility at 6250 Mountain Vista St D-1, Henderson, NV 89014.  

1. INFORMATION WE COLLECT 

Information you provide: 

- Contact information: name, email address, phone number, and mailing address. 

- Membership information: tier, household members, enrollment dates, attendance, rank and testing history. 

- Emergency contact and medical information you provide on our Emergency Contact & Medical Information form, such as injuries, conditions, or medications relevant to safe participation. 

- Information about minors, provided by a parent or legal guardian. 

- Signed documents: membership agreements, liability waivers, Code of Conduct acknowledgments, and photo/video consent forms. 

- Messages you send us through the Site, email, or text.  

Information collected through payments: 

- Payments are processed by GymDesk Payments. We do not store full credit card or bank account numbers on our systems.  

Information collected automatically: 

- When you visit the Site, our hosting provider and Google Analytics may collect your IP address, browser and device type, pages visited, time spent on pages, and the referring website, using cookies and similar technologies.  

Photos and video: 

- We may take photos or video during classes and events. Their use is governed by the Photo & Video Consent form on file for each participant.  

2. HOW WE USE YOUR INFORMATION 

We use personal information to: 

- Enroll members, manage accounts, and process payments. 

- Schedule classes, testing, seminars, and events. 

- Keep participants safe and respond to injuries or emergencies. 

- Send account notices, class reminders, schedule changes, and updates about our programs. 

- Respond to questions and requests. 

- Understand how the Site is used so we can improve it. 

- Meet legal, insurance, and record-keeping obligations.  

3. HOW WE SHARE YOUR INFORMATION 

We do not sell your personal information. We share it only with: 

- GymDesk, our membership management platform, and GymDesk Payments, our payment processor. 

- GoDaddy, our website host, and Google Analytics, our website analytics provider. 

- Our email service provider and, when offered, our text messaging provider, only to send messages to you. 

- Emergency responders and medical providers, when needed to respond to an injury or emergency. 

- Government authorities or other parties when required by law, or to protect the safety, rights, or property of our members, staff, or the public. 

These service providers may use your information only to provide services to us.  

4. TEXT MESSAGES 

If you opt in to text messages, we may send class reminders, schedule changes, and account notices. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help at any time. Consent to receive texts is not a condition of membership. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging opt-in data and consent will not be shared with any third parties.  

5. EMAIL 

You may unsubscribe from promotional emails at any time using the link in the email. We will still send account, billing, and safety-related messages while you are a member.  

6. COOKIES, ANALYTICS & DO NOT TRACK 

The Site uses cookies, including through Google Analytics, which may collect information about your online activity over time and across different websites. You can block or delete cookies in your browser settings, and you can opt out of Google Analytics at https://tools.google.com/dlpage/gaoptout. The Site does not currently respond to browser "Do Not Track" signals.  

7. CHILDREN'S PRIVACY 

The Site is not directed to children under 13, and we do not knowingly collect personal information directly from them. Information about participants under 18 is provided and managed by a parent or legal guardian. If you believe a child under 13 has given us personal information directly, contact us and we will delete it.  

8. DATA RETENTION 

We keep personal information only as long as needed for the purposes in this policy and to meet legal, insurance, and record-keeping obligations. In general: 

- Contact, attendance, and emergency/medical information: up to 2 years after membership ends. 

- Liability waivers and incident reports: at least 3 years after last participation, and for participants who were minors, until they reach age 21. 

- Membership agreements and billing records: up to 7 years after membership ends. Information may be kept longer if needed for a legal claim or required by law.  

9. HOW WE PROTECT YOUR INFORMATION 

We use reasonable administrative, technical, and physical safeguards, including encrypted connections on the Site, access limits on member records, and secure third-party platforms for payments. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.  

10. YOUR CHOICES & RIGHTS 

You may review and update your account information through your member profile, or contact us to request access to, correction of, or deletion of your personal information, subject to our legal and record-keeping obligations. Nevada residents: We do not sell covered information as defined by Nevada law. You may still submit a request directing us not to sell your covered information by emailing admin@massfxcombat.com with the subject line "Nevada Opt-Out."  

11. THIRD-PARTY LINKS 

The Site may link to other websites or services. We are not responsible for their privacy practices, and we encourage you to review their policies.  

12. CHANGES TO THIS POLICY 

We may update this Privacy Policy from time to time. When we make changes, we will post the updated policy on the Site and revise the effective date above. For material changes, we will also notify members by email.
